Yellow3D Terms and Conditions

1. Subject Matter

These Terms govern the use of the Yellow3D website and any other agreements or legal relationships with the Owner in a binding manner.

The User is kindly requested to read this document carefully.

2. Owner

3. Definitions

Site or Service: the Yellow3D website and its e-commerce functionalities.
User: anyone browsing or using the Site.
Customer: anyone making a purchase on the Site.
Consumer: a natural person who makes a purchase for purposes unrelated to their professional activity.
Professional: an entity that makes a purchase for purposes related to its entrepreneurial, commercial, craft, or professional activity.
Products: items sold on the Site.
Order: a purchase proposal sent by the Customer to the Owner.

4. At a Glance

1. The purchase of Products is available to both Consumers and Professionals, unless otherwise indicated during the purchase process.
2. The right of withdrawal is recognized for Consumers according to applicable law and does not apply to Professionals, unless otherwise agreed in writing.
3. For Consumers, the legal guarantee of conformity applies according to current legislation.

5. Terms of Use

Unless otherwise specified, the terms of use set out in this section are generally valid.

By using the Site, the User declares to meet the following requirements:

1. has legal capacity and, if a minor, uses the Site with the consent of the person exercising parental responsibility
2. provides complete and truthful information during registration and purchase
3. uses the Site in compliance with laws, regulations, and third-party rights

6. Registration and Account

The User can create an account by providing the requested data completely and truthfully. It is also possible to make purchases without registration, unless otherwise indicated at checkout.

It is the User's responsibility to keep login credentials secure and maintain their confidentiality.

The Owner may suspend or cancel an account in case of misuse, violations of law or these Terms, or in the presence of fraud risk or attempts to abuse the Service.

7. Content on the Site and Rights

Unless otherwise specified, all content available on the Site is owned by the Owner or its licensors.

It is forbidden to copy, reproduce, modify, distribute, publish, transmit, sell, or create derivative works from the content of the Site without authorization, except as permitted by law.

8. Access to External Resources

Through the Site, the User may have access to resources provided by third parties. The Owner has no control over these resources and is not responsible for their content or availability.

9. Permitted Use and Owner's Measures

The Site may only be used for the purposes for which it is offered, in accordance with these Terms and applicable law.

The Owner reserves the right to take any appropriate measure to protect its legitimate interests, including limiting or blocking access to the Site, canceling suspicious orders, or reporting unlawful activities to the competent authorities.

10. Terms and Conditions of Sale

10.1 Products, Description, Availability

Prices, descriptions, and availability of Products are indicated on their respective pages and may vary over time.

Images and graphic representations are illustrative and may differ depending on the device and settings. The characteristics of the selected Product are those indicated during the purchase procedure.

For sealed Products, the Owner cannot guarantee specific contents within the packaging. Any probabilities, rarities, or outcomes depend on the manufacturer and chance.

10.2 Purchase Procedure

Each step from product selection to order submission is part of the purchase procedure. Before submitting the Order, the Customer views a summary, price, applicable taxes, shipping costs, and total.

10.3 Conclusion of the Contract

Submitting the Order entails the Customer's obligation to pay the price and any additional charges indicated. The contract is concluded when the Owner confirms the Order, including via shipping or fulfillment confirmation email, or other explicit confirmation.

In case of unavailability, material error, or inability to accept the Order, the Owner will provide notice and proceed to refund any amounts received.

10.4 Prices

Prices are those indicated on the Site at the time of the Order. Any shipping costs and additional charges are shown before Order confirmation.

10.5 Payment Methods

Payments can be made using the methods available at Shopify checkout, including Stripe, PayPal, and Scalapay, where active.

Payments are managed by third-party providers. The Owner does not store full payment details and only receives the outcome and information necessary for Order management.

If payment fails or is refused, the Order cannot be processed and may be canceled.

10.6 Installment Payment

If available, installment payment via Scalapay is governed by the terms of the relevant provider. Some Products may be excluded from this method.

10.7 Pre-orders

When a Product is on pre-order, the indicated release and shipping dates are estimates and may be subject to changes due to reasons beyond the Owner's control, including changes by the manufacturer or distributor.

In case of significant changes, the Customer will be informed. If a pre-order cannot be fulfilled, the Owner may cancel the Order and refund any amounts paid.

10.8 Delivery

Deliveries are made to the address indicated by the Customer. Times and costs are indicated at checkout and may depend on destination, period, and courier.

Upon delivery, the Customer is required to check the condition of the package and promptly report any anomalies.

10.9 Non-delivery and Storage

The Owner is not responsible for delivery errors due to incorrect or incomplete data provided by the Customer. In case of storage or failure to collect, any return or re-shipping costs may be charged to the Customer, to the extent permitted by law.

11. Right of Withdrawal, Consumers Only

Unless an exception provided by law applies, the Consumer may withdraw from the contract within 14 days without providing a reason.

11.1 Terms

The withdrawal period expires 14 days after the day on which the Consumer or a third party designated by them acquires physical possession of the goods.

11.2 How to Exercise Withdrawal

To exercise the right of withdrawal, the Consumer must send an unequivocal communication to info@yellow3d.it indicating at least: order number, items, full name, email used for the order, address.

11.3 Return of Goods

The Consumer must return the goods without undue delay and, in any case, within 14 days from the communication of withdrawal.

Return shipping costs are borne by the Consumer, unless otherwise indicated.

The address and operational instructions for the return will be communicated via email, to ensure proper management and traceability.

11.4 Refund

The Owner will refund all payments received, including standard delivery costs, within 14 days from the date on which they are informed of the decision to withdraw.

The Owner may withhold the refund until receipt of the goods or until the Consumer has demonstrated having sent back the goods.

The refund will be processed using the same means of payment used for the initial transaction, unless otherwise agreed.

11.5 Diminution in Value

The Consumer is responsible for any diminution in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

12. Legal Guarantee of Conformity, Consumers

For Consumers, the legal guarantee of conformity applies. In case of a lack of conformity, the Consumer is entitled to the remedies provided by law, including restoration of conformity through repair or free replacement and, in the cases provided for, price reduction or termination of the contract.

13. Limitation of Liability

To the extent permitted by law, the Owner is not responsible for service disruptions due to force majeure or events beyond its control, nor for damages resulting from improper use of the Products.

Liability for willful misconduct or gross negligence and the mandatory protections provided for Consumers remain unaffected.

14. Modification of Terms

The Owner reserves the right to modify the Terms at any time. Changes will take effect from the moment of their publication on the Site.

15. Applicable Law and Jurisdiction

If the Customer is a Consumer, the mandatory protections provided by the legislation of the Consumer's habitual residence country apply.

For Professionals, unless mandatory rules apply, the court of the place where the Owner is established has jurisdiction.

16. Complaints and Dispute Resolution
